HOW LONG DOES CONVEYANCING TAKE?+ HOW LONG DOES CONVEYANCING TAKE?-

The timescale for a residential conveyancing transaction will vary depending on factors such as the complexity of the transaction, whether there is a chain, and whether all the documentation needed is available at the outset.  However, a simple sale or purchase of a freehold property will typically take around 10 to 12 weeks.

 

WHAT WE WILL DO - SALE OF A PROPERTY+ WHAT WE WILL DO - SALE OF A PROPERTY-

During the course of your sale we will:

  • - Take your instructions
  • - Obtain title information (if the property is registered, this will be from the Land Registry; if unregistered, you will need to provide us with the title deeds)
  • - Send the contract and title documentation to the buyer’s solicitor
  • - Reply to any enquiries raised by the buyer’s solicitor
  • - Ask your lender for a redemption figure (to pay off your mortgage) (if applicable)
  • - Arrange for you to sign the contract and any other required documentation
  • - Agree a completion date (date at which you sell the property)
  • - Exchange contracts and tell you this has happened
  • - Complete the sale
  • - Redeem your mortgage (if applicable)
  • - Deal with the sale proceeds and post completion matters
 

WHAT WE WILL DO - PURCHASE OF A PROPERTY+ WHAT WE WILL DO - PURCHASE OF A PROPERTY-

During the course of your purchase we will:

  • - Take your instructions and give you initial advice
  • - Check the finances are in place to fund the purchase
  • - Receive contract documentation from the seller’s solicitors – we will review and advise you on it
  • - Carry out searches (typically these are local authority, drainage and environmental, but others may be needed depending on the area you are buying in)
  • - Obtain further planning or building regulations documentation if needed
  • - Draft the Transfer document
  • - Raise any necessary enquiries with the seller’s solicitors
  • - Give you advice on all the documents and information received
  • - Go through the conditions of the mortgage offer with you (if applicable)
  • - Send the final contract and other necessary documentation to you for signature
  • - Advise you on joint ownership (if applicable)
  • - Agree a completion date (the date from which you own the property)
  • - Exchange contracts and tell you when this has happened
  • - Arrange for all monies needed from you and the lender (if applicable) to be in our client account
  • - Complete the purchase
  • - Deal with payment of Stamp Duty Land Tax
  • - Apply for registration of your ownership of the property at the Land Registry

If you are buying a Leasehold property we will need to take a few more steps in addition to those listed above:

  • - Review the Management Pack and Leasehold Property Enquiries
  • - Make any necessary enquiries in relation to the leasehold information
  • - Deal with apportionments of service charge and ground rent
  • - Serve the required notices on completion to the landlord and/or management company
 

WHAT WE WILL DO - REMORTGAGES+ WHAT WE WILL DO - REMORTGAGES-

Re-mortgaging is the process of either releasing some of the equity in your home, changing your mortgage for a better rate or consolidating your debts. To re-mortgage, you need to end your current mortgage and move to a new one which may involve switching Lenders.

Re-mortgaging involves legal work to secure the interest of your new Lender and usually to discharge any existing securities. It is therefore prudent to have a Solicitor to help you through this process.

You should consult an Independent Financial Advisor (IFA) to obtain information to assist you in finding the best mortgage package to suit your needs and we can recommend an IFA if you need help.

We will:

  • - Take your instructions
  • - Obtain title information from the Land Registry
  • - Obtain a redemption figure from your current lender
  • - Review the mortgage offer
  • - Report to you on the conditions of your mortgage offer
  • - Arrange for you to sign the Mortgage Deed
  • - Agree a completion date for the new mortgage
  • - Request mortgage funds from the new lender
  • - Complete the remortgage
  • - Deal with redeeming your old mortgage
  • - Apply to register the new mortgage at the Land Registry

TRANSFERS OF EQUITY+ TRANSFERS OF EQUITY-

A Transfer of Equity occurs when one or more joint owners of land or property wish to transfer any interest that they may have in the land or property to another co-owner of that property. There are a number of reasons for arranging the Transfer of Equity however the most common occurs on the dissolution of a marriage or when co-habitees decide to live separate and apart. In either case it is advisable to instruct a Solicitor.
